Terms of Sale

These terms govern sales made by ARTGENCE INC. ("Artgence", "we") through this website to consumers and professional buyers.

1. The works

Every work offered is an original, one-of-a-kind piece. Because each is unique, a work is withdrawn from sale as soon as it is purchased. Photographs are representative; minor variation in colour and texture is inherent to works made from reclaimed material and is not a defect.

2. Prices

All prices are shown in euros, inclusive of all taxes. The price displayed is the price you pay — there are no charges added at checkout beyond any shipping cost shown before you confirm. Applicable VAT is calculated at checkout according to your delivery country and is contained within the displayed price. For delivery in France, the price includes French VAT on works of art at the reduced rate of 5.5% (CGI art. 278-0 bis, I). For delivery outside France we do not add VAT; import duty, import VAT and clearance fees may be payable on arrival and are your responsibility.

3. Order and formation of contract

Placing an order constitutes an offer to purchase. The contract is formed when we confirm the order by email. We may decline an order where a work is no longer available, where a pricing error is manifest, or where we cannot ship to the stated destination.

4. Payment

Payment is processed by Stripe. We do not receive or store your card details. Payment is taken in full at the time of order.

5. Delivery

Delivery terms, destinations and timeframes are set out in our Shipping policy. Risk passes to you on delivery.

6. Right of withdrawal

Consumers have 14 days from receipt to withdraw without giving a reason. See our Returns & Withdrawal policy for how to exercise it.

7. Legal guarantees

Consumers benefit from the legal guarantee of conformity (Code de la consommation art. L217-3 et seq.) and the guarantee against hidden defects (Code civil art. 1641 et seq.), independently of any commercial guarantee.

8. Authenticity

Each work is supplied with a Certificate of Authenticity recording the artist, the materials, and the provenance information supplied to us by the artist.

9. Governing law and language

These terms are governed by French law. Nothing here deprives a consumer of the mandatory protections of the law of their country of residence. These terms are published in French and in English; the French version is the reference version and prevails for consumers resident in France.
